Even though I'll disagree with both "offensive" and "inappropriate," this was still -- how to put it? -- conspicuously out of place among the other Volokh Conspiracy posts, as much for being poorly thought out as for anything else.
(He must be trying to explain rather than persuade, since the post contains no attempt at anything beyond bare assertions of things that aren't very useful to assert.)
